This piece examines the Supreme Court’s Draft Regulations on the Use of Artificial Intelligence in Courts, 2026, and highlights a significant gap in the proposed framework. While the Draft Regulations govern the use of AI in courts, they do not provide a dedicated remedy for harms caused by the authorised use of AI. Looking at global best practices, it is argued that the Regulations should include a right to explanation and a dedicated grievance redressal mechanism to promote accountability, transparency, and public confidence in the justice system.
